Colorado Nestlé Purina Petcare facility emits noxious odors, class action claims
A pair of consumers have filed a class action lawsuit against Nestlé Purina Petcare Co. in late May due to claims of its Colorado facility emitting foul odors not controlled or moderated by the company.
The class action lawsuit argues that more than 2,000 households are located within a mile of the Denver facility and that residents have filed numerous complaints over the years about the odor.
“A properly designed, operated and maintained pet food manufacturing facility will adequately capture, remove and dispose of excess toxic emissions and will not release noxious odors into the ambient air as fugitives emissions,” said the Nestlé class action.
Pup-Peroni dog food does not use real beef as advertised, class action says
A consumer has filed a class action lawsuit against Big Heart Pet Brands Inc. in April due to the company’s false advertising of their Pup-Peroni dog food uses real beef as its main ingredient.
The class action lawsuit alleges that the top ingredient in Pup-Peroni dog food is actually feed-grade beef, which is allegedly of lower quality and requires intense processing, reducing its nutritional integrity and potentially creating harmful substances.
“The plaintiff is like most consumers unaware that the beef used in the product is feed-grade beef of a lower quality and type than the type of beef he would buy or consume for himself. ,” the Pup-Peroni class action said.
Mid-America Pet Food responsible for salmonella contamination, class action claims
A group of consumers filed a class action lawsuit against Mid-America Pet Food in April over the company’s claims failed to properly handle its pet food productsleading to salmonella contamination.
The class action lawsuit alleges that Mid-America failed to take necessary steps to prevent a series of recalls last year related to salmonella contamination.
“Had the plaintiff known that the pet food products contained salmonella contaminants or had the defendant failed to inspect and test the pet food products and ingredients for contaminants adequately, the plaintiff would not have purchased the pet food products,” the Mid-America class action said.
Class certification upheld for claims Nutramax mismarketed pet health supplements
A class of pet owners had a 9th Circuit panel uphold their class certification in April for a class action lawsuit they filed against Nutramax Laboratories Inc. and Nutramax Laboratories Veterinary Sciences Inc.
The class action lawsuit alleges that Nutramax mismarketed its Cosequin pet health supplement products to promote healthy joints and mobility in dogs.
Nutramax unsuccessfully argued that the district court erred in relying on a proposed damages model created by plaintiffs’ expert to find that common questions predominate in damages.
“The panel believes that, contrary to Nutramax’s contention, there is no general requirement that an expert actually apply to the proposed class a reliable injury model to demonstrate that the injuries are susceptible to standard proof at the certification stage of class,” the 9th Circuit wrote.
Bausch + Lomb Project Watson Eyelid Wipes for dogs due to bacteria, fungi concerns
Bausch + Lomb issued a recall for about 32,000 units of Project Watson Eyelid Wipes for dogs last month due to bacteria and fungi concerns can be introduced in their containers, posing a risk of infection.
The concern involves Project Watson Eyelid Wipes for dogs sold in 45-count containers with multiple numbers of either A09050 or A10055 printed on the bottom.
Consumers should immediately stop using the recalled Bausch + Lomb dog eyelid wipes and request a refund by submitting a photo of the product to a website set up for recall before discarding the wipes.
Mars Petcare is recalling Pedigree dog food in loose metal pieces
Mars Petcare US issued a voluntary recall in May for 315 bags of Pedigree Adult Complete Nutrition Grilled Steak & Vegetable Flavor Dry Dog Food due to concerns that it may be a dog food. contaminated with loose pieces of metal.
The concern includes Pedigree Adult Complete Nutrition Grilled Steak & Vegetable Flavor Dry Dog Food packaged in a 44-lb. bag with lot code 410B2TXT02 and a best-by date of March 4, 2025.
Walmarts in Arkansas, Louisiana, Oklahoma and Texas sold the recalled pet food. Consumers should stop using the recalled Pedigree dog food and monitor the behavior of pets that may eat it.
